Advice for Claims with Income or Expenditure Discrepancies

The most recent tactic used by PayDay Lenders is to imply you provided a fraudulent application.  Lenders are suggesting you knowingly provided incorrect information regarding your income and expenditure at the time of applying for the loan.

What the letters say

Many complaints have been responded to by lenders implying “irresponsible borrowing”.  Lenders state this occurred by knowingly providing a greater estimation of what you were earning at the time and/or smaller expenses than you actually had.

The letters received are not only are factually incorrect (such as having been able to check your salary level) but take a threatening tone and the reason for such a response is to put you off taking your claim any further and getting back the money you are rightly owed.

If everyone stops their claim as a result of this letter this will save lenders a lot of money!

My application figures are incorrect.  Can I still claim?

YES!

Debt Camel has published an article recently which explains why, in many circumstances, why the figures you provided may have been inaccurate and if it would be an issue for your complaint being upheld.

Debt Camel has also provided examples of claims in this situation where the Financial Ombudsman Service has upheld the claim and agreed with the borrower!
